All transactions are solely between the buyer and the seller. We have no control over, and make no representations regarding, the quality, safety, legality, or accuracy of any listing, the ability of any seller to complete a sale, or the ability of any buyer to complete a purchase.

You use this Site and engage in any transaction entirely at your own risk. We strongly encourage you to independently verify all listing details, inspect any vehicle before purchase, and consult appropriate legal or financial professionals.

3. Listings and Content

Our Site contains listings submitted by sellers and aggregated from third-party sources. We do not verify the accuracy, completeness, or legality of any listing. Listings may contain errors or become outdated. You are responsible for verifying all information independently before making any purchasing decision.

By submitting a listing, you represent that:

• You own or have the right to sell the vehicle listed.
• All information provided is accurate and not misleading.
• The listing does not infringe any third-party rights.
• The vehicle complies with all applicable laws and regulations.

4. Prohibited Conduct

You agree not to:

• Post false, misleading, or fraudulent listings.
• Use the Site for any unlawful purpose.
• Scrape, copy, or reproduce our content without permission.
• Attempt to gain unauthorized access to our systems.
• Harass or harm other users.
• Post content that infringes any intellectual property rights.

5. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, BUYAFOODTRUCK.COM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY TRANSACTION BETWEEN BUYERS AND SELLERS, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

7. Indemnification

You agree to indemnify, defend, and hold harmless BuyAFoodTruck.com and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including attorneys' fees) arising from your use of the Site, your listings, or your violation of these Terms.

8. Featured Listings & Payments

Featured listing fees are non-refundable once a listing has been promoted. Payments are processed by Stripe. By purchasing a featured listing, you agree to Stripe's terms of service.

9. Termination

We reserve the right to remove any listing or suspend any account at our sole discretion, without notice, for any reason including violation of these Terms.

10. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of competent jurisdiction in the United States.

11. Changes to These Terms

We may update these Terms at any time. Continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.
